The Work of the Committee on Economic, Social & Cultural Rights

 

The 2024 CESCR Yearbook shows a Committee operating under heavy constraints, as the UN liquidity crisis forced the cancellation of pre-sessional working groups and the suspension of hybrid modalities. These disruptions deepened existing backlogs and limited civil society engagement, yet the Committee continued its work by reviewing States, issuing follow-up assessments and progressing on its thematic agenda. 

Across its reviews, the Committee identified recurring concerns including persistent discrimination against marginalised groups, weak labour protections, barriers to education, and insufficiently targeted poverty reduction measures. Housing remained one of the most prominent issues, with forced evictions and the absence of adequate safeguards appearing frequently. Environmental sustainability and climate-related obligations featured more prominently in State assessments, and fiscal policy continued to gain importance as the Committee advanced internal discussions on a future Statement on taxation and economic, social and cultural rights. Civil society participation declined compared to the previous year but remained essential to informing the Committee’s analysis.

In its individual communications, the Committee issued a mix of merits decisions and a high number of discontinuances. While housing cases continued to dominate, the Committee also addressed new substantive questions, including cultural rights in the context of Indigenous Peoples’ land and livelihoods. Thematic work progressed on draft General Comments relating to sustainable development, drug policy and the impact of armed conflict on economic, social and cultural rights, although no new Statements or Days of General Discussion were held.

The Yearbook portrays a Committee striving to maintain its oversight role and continuing to lead in advancing standards on ESC rights, despite challenges.
